We will work through the following process with you to ensure your fund is set up in the best way possible.
- SMSF structure – We will determine the structure of your fund, based on your individual circumstances, for example single member, individual trustees or a corporate trustee.
- Establish a Trust – Firstly, we register your SMSF with the ATO by establishing a trust.
- Obtain the trust deed - We engage a specialist legal practitioner who understands superannuation law (and SMSFs in particular), to designed a well-drafted trust deed which sets out factors such as the structure of the fund, your investment strategy, who can be beneficiaries and how benefits can be paid.
- Sign a declaration – You will sign a declaration from the ATO stating that you understand your obligations, duties and responsibilities as a trustee or director of the corporate trustee of an SMSF.
- Lodge an election with the regulator – We will assist you to lodge an election to be regulated with the ATO advising that the SMSF will be subject to the requirements of the relevant superannuation legislation and will be entitled to the concessional taxation rate of 15% as a complying fund.
- Open a cash account – Finally we can assist you to set up a cash account so that your SMSF can accept contributions, rollovers and earnings from investments. This account will later be required to pay expenses such as annual supervisory levy, accounting fees, taxation liabilities and importantly, member benefits.
We can arrange an annual audit by an approved SMSF auditor on your behalf.
Each year we will prepare and lodge your fund’s annual return with the ATO. This includes financial accounts and statements that meet the accounting standards reporting member contributions and paying the SMSF supervisory levy.
We are required to supply comprehensive records, including accurate tax and accounting records, minutes regarding all trustee meetings and decisions, trustee declarations recognising their obligations and responsibilities, and copies of all reports given to members.
